Will* | 2 February 1818 | Friskney, Lincolnshire; This is the last Will and testament of me Samuel Whiley of Friskney in the County of Lincoln Grasier First I will that all my just Debts be paid And I give and devise unto my natural son William Whiley All that my Messuage or Tenement Land and Hereditaments Situate lying and being in Leake in the said County of Lincoln lately purchased by me of Jonathan Westland and now in the Tenure of the said William Whiley To hold the same unto my said Son William Whiley his Heirs and Assigns for ever Also I give devise and bequeath to my Friends John Longstaff Grantham of Boston in the said County of Lincoln Butcher and Bletcher Creasey of Friskney aforesaid Farmer their Heirs Executors and Administrators and Assigns All and every my Messuages Shop Granary Lands tenements Hereditaments and Real Estates situate lying and being in the Parish of Friskney aforesaid and in Wainfleet All Saints in the said County of Lincoln And also all and singular my Monies Securities for Money Goods Stock Chattels personal Estate and Effects whatsoever and wheresoever and of what nature or kind soever To hold the same unto and to the use of them the said James Longstaff Grantham and Blecher Creasey their heirs Executors Administrators and Assigns according to the different Natures and Qualities thereof respectively But nevertheless Upon Trust that they the said James Longstaff Grantham and Bletcher Creasey or the survivor of them his Heirs Executors or Administrators and do as soon as conveniently may be after my decease Absolutely sell and dispose of my said Messuages Shop Granary Lands Tenements Hereditaments and Real Estate and also of such Part of my Personal Estate as shall not consist of Money or Securities for Money for the most money and best price that can be reasonably had and gotten for the same And for the facilitating the Sale of my said Real and Personal Estates I do hereby will direct and declare that the Receipt or Receipts of the said James Longstaff Grantham and Bletcher Creasey or the Survivor of them his Heirs Executors or Administrators under their or his Hands or hand shall be efficient and effectual Discharges to the Person or Persons who shall Purchase the same Premises or any part thereof for his or their Purchase money and that such Purchaser or Purchasers shall not afterwards be answerable or accountable for any Loss Misapplication of Nonapplication of such Purchase Money or any part thereof And I do hereby Will and direct that they the said James Longstaff Grantham and Bletcher Creasey or the Survivor of them his Heirs Executors or Administrators shall stand possessed of and interested in all and singular the Monies arising by such Sales or Sales of my said Real and Personal Estates and of all such other Monies and Securities for Money as I may die possessed of or be entitled to at the time of my decease and by the Rents Issues produce and profits of the said Hereditaments and Premises repectively in the mean time and until the same shall be so sold Upon the Trusts and for the Intents nad Purposes following (that is to say) Upon Trust that they the said James Longstaff Grantham and Bletcher Creasey or the Survivor of them his Executors or Administrators do and shall place the same out at Interest in their Names on Government Real or other sufficient Security the Sum of seven hundred Pounds and the same to call in and place out again as aforesaid as they shall think proper and pay to or permit and suffer and Authorise my Dear Wife Mary Whiley and her Assigns so long as she shall continue to be my Widow to receive and take the Interest dividends and produce thereof from time to time as the same shall become due and payable to and for her own use and benefit But is she shall marry again Then my Mind and Will is That from the time of such her second Marriage the Yearly Interest Dividends and produce of the said Sum osf Seven hundred Pounds so directed to be placed out for her benefit as aforesaid shall cease and be no longer paid to her And I do will and declare that the said Sum of Seven hundred Pounds so directed to be placed out for the Benefit of my said Wife so long as she shall continue my Widow as aforesaid shall from and immediately after her second Marriage or decease which ever event shall first happen go and revert and be paid unto and amongst my said Son William Whiley and my Children Elizabeth the wife of the said James Longstaff Grantham Frank Whiley Ann the Wife of Samuel Webster of Wainfleet All Saints aforesaid Miller John Whiley Mary Whiley and Samuel Whiley in equal Shares and proportions with such Interest and at such time or times and with such Benefit of Survivorship and Maintenance and Education in the mean time and in such manner as I have hereinafter directed with respect to the Shares of my said Children in the residue of the said Principal Trust Monies And Upon further Trust that they my said Trustees or the Survivor of them his Executors or Administrators do and shall pay unto my said Children Frank Whiley Ann the Wife of the said Samuel Webster John Whiley Mary Whiley and Samuel Whiley the Sum of Three hundred Pounds a Piece in manner following (that is to say) to the said Frank Whiley Ann the Wife of the said Samuel Webster and John Whiley within twelve Calendar Months after my decease And to the said Mary Whiley and Samuel Whiley as and when they shall severally attain their respective Ages of twenty one years to whom I do hereby give and bequeath the same accordingly having already Advanced and paid to my said Son William Whiley and my said Daughter Elizabeth Grantham the Sum of three hundred Pounds for their own Use and Benefit And as to all the rest residue and remainder of the Monies to arise by Sale of my said Real and Personal Estates and all such other Monies or Securities for Money as I shall or may die possessed of or be entitled to at the time of my decease as aforesaid Subject to the Payment of all my just Debts the Legacies hereinbefore by me given and bequeathed my Funeral Expences and the Expence of Proving this my Will Upon Trust that they my said Trustees or the Survivor of them his Executors or Administrators do and shall place the same out at Interest on government Real or other sufficient Security and the same from time to time to call in and place out again as aforesaid as they shall think proper In trust for my said Children Elizabeth the Wife of the said James Grantham Frank Whiley ann the Wife of the said Samuel Webster John Whiley Mary Whiley and Samuel Whiley and to be paid to them in equal Shares and proportions at the times and in manner following (that is to say) to my said Daughters Elizabeth the Wife of the said James Longstaff Grantham and Ann the Wife of the said Samuel Webster and to my said Sons Frank Whiley and John Whiley at the end of twelve Calendar Months next after my decease or sooner at the Discretion of my said Trustees and to my said Children Mary Whiley and Samuel Whiley as and when they shall severally attain their respective Ages of twenty one years or to be sooner paid for their advancement or preferment in the world at the Discretion of my said Trustees or the Survivors or Survivor of them his Executors or Administrators and in case my said Children Frank Whiley Ann Webster John Whiley Mary Whiley and Samuel Whiley shall happen to die without lawful Issue before his her or their Legacy or Legacies or Share or Shares of and in the said Principal Trust Monies shall become payable under or by Virtue of this my Will the Legacy or Legacies and Share or Shares of him her or them so dying shall go and belong to the Survivors or Survivor of them the said Elizabeth Grantham Frank Whiley Ann Webster John Whiley Mary Whiley and Samuel Whiley in equal Shares and Proportions and to be paid as follows (that is to say) To my said Daughters Elizabeth Grantham and Ann Webster and to my Sons Frank Whiley and John Whiley within six months next after such Death so happening as aforesaid and to my said Children Mary Whiley and Samuel Whiley at such time or times as his her or their Original Legacy or Legacies or Share or Shares is or are so directed to be paid as aforesaid And I will that what shall so survive shall from time to time likewise survive and go or be paid in like manner Provided always and my mind and will is that in Case my said Son in Law Samuel Webster shall within three Calendar Months next after my Death signify in Writing under his Hand his desire to my said Trustees or the Survivor of them to become the Purchaser of the Messuage or Tenement Shop Granary and premises lately Purchased by me of the Trustees of the late David Wright Shopkeeper and now in the Occupation of the said Samuel Webster hereinbefore (together with my other Real Estates) directed to be sold for the Price or Sum of Four hundred Pounds Then and in such Case it shall and may be lawful for my said Trustees or the Survivor of the And I do hereby authorize and direct them or him upon Payment or tender to them or him by said Son in Law Samuel Webster of the said Sum of Four hundred Pounds to convey the same to the said Samuel Webster and his Heirs or in such manner as he shall direct at his Expence And I do further declare my Will to be that in the mean time or until such Legacies or Shares respectively shall become Payable under or by virtue of this my Will It shall be lawful for my said Trustees or the Survivors or Survivor of them his Executors or Administrators to pay and apply such Sum or Sums of Money by or out of the Interest Dividends and produce of the said Principal Trust Monies and Premises for and towards the maintenance and support of my said Children not exceeding the Interest of his her or their Legacy and Share or respective Legacies and Shares of the said Principal Trust Monies as they my said Trustees or the Survivor of them his Executors or Administrators shall in their or his discretion think fit And I do hereby further will and direct that it shall and may be lawful to and for my said Trustees their Executors or Administrators by or out of the same Principal Trust Monies or the Interest produce or profits thereof to deduct and retain to themselves in the first place all such Costs Charges damages and Expences as they or any of them shall necessarily bear pay expend or be put unto for or by reason or on account of the Trusts hereby in them reposed or in the defence or Execution thereof or in anywise relating thereto And also that they my said Trustees their Executors or Administrators shall not be answerable or accountable for any more of the said Trust Monies and Premises than what shall actually come into their Hands respectively under or by Virtue of this my Will nor one of them for the other or others of them nor for the Acts Deeds Defaults or Receipts of the other or others of them but each and every of them with or for his own proper acts Deeds Defaults and Receipts only (their joining in receipt for Conformity only notwithstanding) nor with or for any involuntary Loss or Damage that shall or may happen to the said Trust Premises or any part thereof And I do hereby constitute and appoint the said James Longstaff Grantham and Bletcher Creasey Executors of this my Will Upon the Trusts aforesaid and with my said Wife Mary Whiley Guardians for my said Children during their respective minorities And Lastly revoking all former Wills by me at any time heretofore made I do publish and declare these four Sheets of Paper written on one side only and each of them signed by me and the last of them sealed with my Seal to be my last Will and Testament this Second Day of February One thousand eight hundred and eighteen These four Sheets of Paper written on one side only were each of them signed by the said Samuel Whiley the Testator and the last of them sealed with his Seal and were by him published and declared as and for his last Will and Testament in the presence of us who in his presence and at his request have subscribed our Names as Witnesses thereto Geo. W. Straw Sam. Hen. Jebb Tho.
