This is the last Will and Testament of me Michael Power of Wilberforce in the Colony of New South Wales Farmer. I direct that my my Executors hereinafter named shall at my decease make sale and disposal of all my personal goods and effects (except as hereinafter mentioned with reference to a bed and clothes, and box and clothes) And after payment thereout of my just debts funeral and testamentary expenses, I direct, that my said Executors shall stand possessed of the net proceeds thereof Upon Trust to lay out and expend weekly the sum of five shillings in and towards the maintenance and support of my idiot son Michael Power the younger so long as shall be necessary until one Matthew Maloney shall be entitled and shall come to the possession of the farm and premises on which I now reside at Wilberforce aforesaid by virtue of an Indenture in that behalf made by me in favor of the said Matthew Maloney upon condition of his keeping and maintainin my said Son (and his mother my wife during their joint lives) And also Upon Trust to retain and expend the sum of Twenty pounds Sterling on top of the said proceeds in and towards the expense and charge of burying my said wife at her decease which I charge my said Executors with the care and accomplishment of in a decent and becoming manner; And in case there shall be any residue of the said proceeds of my personal estate after the fulfilment of the Trusts last aforesaid then I give and bequeath such residue unto and equally between my said Executors absolutely I direct that my said executors shall retain from my said goods, and effects the bed and clothes, and box and clothes now used by my said son for the use of my said son during his life and afterwards the same to form part of my personal estate aforesaid I appoint my said Executors or the survivor of them to be the Guardian or Guardians of my said idiot Son and authorise and request them or the survivor of them to look after his interest in the farm aforesaid I declare that a debt owing to me by John Cunningham the younger (one of my Executors hereinafter named) shall form part of my personal estate and effects hereinbefore disposed of, and shall be paid accordingly by the said John Cunningham (unless the same be settled with me previous to my decease) I nominate and appoint John Cunningham the younger of Windsor in the Colony aforesaid, and George Cunningham of Wilberforce in the said Colony, farmers, to be the Executors of this my Will, with full power to receive compound and pay debts owing to or by me I devise unto my said Executors all Estates vested in me as Trustee or Mortgagee subject to the trusts and equities affecting the same respectively. Lastly I revoke all former Wills.

Signed by the said Testator Michael Power with his mark in the presence of us present at the same time who at his request in his presence and in the presence of each other that hereunder subscribed our names as Witnesses – the words “and his mother my wife during their joint lives” in the eighteenth and nineteenth lines from the top of the first page hereof having previously been struck out.

This is a Codicil to the before written Will of me the before named Michael Power. I devise a farm of Thirty acres situated at Sally’s bottom in the County of Cook and Colony of New South Wales granted to me by the Crown, bounded on one side by Thomas Stone at present in the occupation of Thomas Delaney unto my nephew Frederick McCoy of Newtown Sydney his heirs and assigns absolutely.
I confirm my said Will in all other respects

This day upon Petition Probate of the last Will and Testament of Michael Power deceased was granted to John Cunningham the younger, and George Cunningham the Executors in the said Will named.
