I desire that my just debts and funeral and testamentary expenses may be paid and satisfied as soon as conveniently may be after my decease. I give devise and bequeath unto my dear Wife Ann the whole of my property both real and personal and whether in possession reversion remainder or expectancy for her absolute use and benefit.
And I desire that my said wife will maintain and educate my Children until they come of age. And also that as each Child attains the age of twenty one years She will pay to him or her one fourth part of the Estate then in her possession reserving the remaining fourth part to herself. And I appoint my said wife sole Executrix of this my Will. And I revoke all former Wills. In witness whereof I the said Testator have to this my last Will and Testament set my hand this fourteenth day of September one thousand eight hundred and seventy five.

This is the last Will and Testament of me Ann Harmer of Yahl Paddock near Mount Gambier in the Province of South Australia Widow I appoint my brother Thomas Williams of Moorak near Mount Gambier aforesaid Station Manager and Charles Clark of Mount Gambier aforesaid Machinist Trustees and Executors of my will and the guardians of my infant children And I declare that the trusts and powers hereof may be executed and exercised by the Trustees or Trustee for the time being of this my will who are herein after referred to as “my trustees” I devise and bequeath all my estate as well real and as personal / and which howsoever the same be for the time being constituted or invested is herein after called “my trust estate” unto and to the use of my trustees their heirs executors administrators and assigns upon the following trusts that is to say Upon trust for such of my children who being sons shall attain the age of twenty one years or being daughters shall attain that age or marry thereunder in equal shares but if there shall be only one such child the whole to go to him or her and the issue of any deceased child to take his or her parents share My trustees may from time to time sell convey assign and convert into money all or any part of my trust estate or let the same for any term not exceeding five years I direct my trustees to invest any part of my trust estate capable of investment on Government securities in South Australia or on Mortgage of Freehold lands I direct my trustees to maintain my infant children out of the income of my trust estate from whatever source the same shall arise and invest any surplus of such income in manner aforesaid The share of every daughter shall be for her separate use and her receipt shall alone discharge my trustees In witness whereof I have hereunto set my hand this twenty third day of December in the year of our Lord one thousand eight hundred and seventy eight
