Divorce Issues In Circuit Court
There were several divorce issues and petitions for the restitution of conjugal rights in the Circuit Court yesterday before Mr. Justice Maxwell. In all cases they were granted. Stories of desertion and domestic unrest were frequent.
WARREN v. WARREN
The singular position of how a wife had tried to live with her husband and with her mother and how she had spent some time at her own home then returned to her mother four or five times and resided there for some time was ventilated in the Circuit Court by Ira Milton Warren when appealing for a restitution of conjugal rights.
When granting the restitution of conjugal rights. His Honor said "By the Gospel when a woman takes a man she should cleave to him and if necessary leave her parents. I see no reason why she should not return."
Ira Milton Warren, of Forestville, South Australia, fitter, said he had lived in Broken Hill until February of 1941. He was married in June, 1940.
After the marriage he and his wife went to live in Sulphide Street. Some time after the marriage, respondent suggested that they go and live with her parents. She said that she was disappointed that she was not living with her mother. Five weeks after the marriage she went to live with her mother. She returned and on four or five occasions she came home and left again. Finally she refused to return. That was about 5 months after the marriage.
Petitioner wrote several letters and finally sold the home. Respondent finally agreed to come to Adelaide and live and then the day before leaving she said she would not go. She said she had thought it over and said that she could not leave her mother.
The petition for restitution was granted.
