This is the last Will and Testament of me Stephen McCabe of Pudman Creek near Burrowa in the Colony of New South Wales Settler. I hereby revoke all testamentary writings heretofore executed by me After payment of all my just debts funeral and Testamentary expenses I give devise and bequeath all my real and personal estate whatsoever and wheresoever to my daughter - Mary McEncroe the wife of Peter McEncroe of Pudman Creek aforesaid Settler to be for her own sole and separate use free from the debts control or engagements of her present or any future husband with whom she may intermarry I appoint my said daughter Mary McEncroe Executrix and Isaac Stevenson of Burrowa aforesaid Executor of this my Will In Witness whereof I have hereunder set my hand this Sixth day of March one thousand eight hundred and seventy nine

SMALL DEBTS COURT.
Mary McEncroe was summoned by Valentine O'Hehir for crossing his leased land with a horse and cart without permission. Damages were laid down at £5. Mr. F. P. Brennan appeared for the defence.
Valentine O'Hehir deposed: On the 13th December last I met Mrs. McEncroe, and asked her if she was going through her purchase land; she asked what land; and I said the land you are on now; she then told me to summons her, and what ever she would be fined she would pay; I spoke to her often about it, but she made no reply, the land is not fenced; it is leased land; I claim £5, damages.
To. Mr. Brennan; The Conroys come through where the defendant was; I have been threatening to sne defendant and the Conroys for trespass; I sue Mrs. McEncroe because she was the first and the last I saw going through; I have the land leased this eight years; she did not bring two funerals through on the same track; it is about five years since she commenced going through the land at first; there was no one with me when I cautioned her.
Mary McEncroe deposed: O'Hehir is my son-in-law; I go through the land he has summoned me for trespasing on occasionally; I have taken two funerals through the same place; he has allowed me to go through this place for five years; I have several times seen teams going across the land; I used to go on the main road until he blocked it up; it is the only track I have to go on cmoing to Burrowa.
Verdict for 1s. and costs.

This is the last Will and Testament of me Mary McEncroe of Pudman Creek in the Colony of New South Wales Widow After the payment of all my just debts funeral and testamentary expense I give devise and bequeath to my daughter Mary the wife of Valentine O’Hehir all lands whatsoever and wheresoever to which I am or may be entitled at the time of my decease for and during the term of her natural life and such life interest to be free and clear of the debts engagements or control of her present or any future husband with whom she may intermarry and after the death of my said daughter I give devise and bequeath the said lands to my grandchild Michael O’Hehir the son of Valentine O’Hehir aforesaid absolutely for his own sole personal use and benefit and the residue of my personal estate goods chattles or effects to which I am or may be entitled to at the time of my decease I give devise and bequeath to my said daughter Mary the wife of Valentine O’Hehir aforesaid d absolutely for her own sole and personal use and benefit free and clear of the debts engagements or control of her present or any future husband with whom she may intermarry save and except the sum of twenty pounds which I give devise and bequeath to the Burrowa Roman Catholic Church for the purpose of monthly masses for myself and any people by the Parish Priest I hereby appoint Isaac Stevenson of Burrowa Grazier Executor of this my Will hereby revoking all former wills or Testamentary dispositions heretofore made by me In witness whereof I have to this my will set my hand this 26th day of September one thousand eight hundred and ninety one
